These Terms of Service ("Terms") govern your access to and use of the TechSmith LLC website and services. Please read these Terms carefully before continuing to use the TechSmith LLC website or contracting TechSmith LLC for services. Use of the website or TechSmith LLC services indicates a consent to be bound by all terms and conditions of the agreement and by our Privacy Policy. If you do not agree with all of the Terms below, you should not proceed in using the TechSmith LLC website or services.
Certain personal information and other information about you may be collected by TechSmith LLC in order to provide you with its services. TechSmith LLC's use of this information is governed by the TechSmith LLC Privacy Policy. Techsmith shall implement and maintain reasonable procedures for protecting personal information in compliance with applicable law and the TechSmith LLC Privacy Policy.
In no event shall TechSmith LLC and its employees be liable for any personal injury, property damage, lost profits, cost of substitute services, loss of goodwill, work stoppage, and/or computer device and/or technology failure or malfunction. TechSmith LLC and its employees will perform testing, upon authorization, to determine any problem(s) with your hardware and/or software. By agreeing to these Terms and upon authorization, you allow TechSmith LLC to conduct this testing at your own risk. Testing may include the opening of cases of computers and/or accessories for purposes of inspection or repair. All written or verbal recommended solutions to computer issues are without warranty. Techsmith employees are not to be held liable for any recommendations. In no event will TechSmith LLC and its employees be held liable for direct, indirect, special, exemplary, punitive, incidental, consequential, or other damages based on any causes of action arising out of use of the TechSmith LLC website or services. It shall be understood customers are responsible for their own data and TechSmith LLC will not be held responsible for any loss of data.
The TechSmith LLC website and all of its contents, features, and functionality (including but not limited to all information, software, texts, displays, logos, images, video and audio, and the design, selection and arrangement thereof), are owned by TechSmith LLC and shall be used solely for research and/or reference purposes and may not be copied, reproduced, rebroadcast, or commercially exploited in any or all part.
By accepting these Terms, you agree to pay for work performed by TechSmith LLC and its employees at your own risk. Any free consultations will be discussed and agreed upon as free prior to any consultation work and will be defined as free at the discretion of TechSmith LLC and its employees. Hourly rates will be discussed prior to commencement of work, with a one-hour minimum charge for all services, excluding a half-hour minimum charge for remote support. Payment may be required before a service has been performed and if not, payment is due upon completion of any work unless TechSmith LLC has agreed prior to the commencement of any work to bill a client for payment to be due upon a later date.
You are free to stop using TechSmith LLC services at any time. We also reserve the right to suspend or end services at any time at TechSmith LLC and its employees' own discretion and without notice. TechSmith LLC may suspend or terminate any use of services if the user is not complying with these Terms or are using these services in a manner that would cause TechSmith LLC legal liability, disrupt the services, or disrupt others' use of services.
We may revise these Terms from time to time. The changes will not be retroactive, and the most current version of the Terms which may be found on the TechSmith LLC website will govern TechSmith LLC and its employees' relationship with its clients.
